Terms of Sales

The general conditions of sale detailed below (hereinafter referred to as the “Terms and Conditions” or “Terms”) govern the contractual relationship between any user of the site www.agrirando.fr (hereinafter “the Client” or “You”) and Gilles DUPUY, guide for Agri Rando tours, registered with the RCS under number 332 129 139, residing at Lagrange 19430 La Chapelle St Geraud
(Hereinafter “DUPUY Gilles” or “The Individual Enterprise”).

Article 1: General Provisions

The company sells themed tours on different farms to discover  natural and historic heritage
(Hereinafter referred to as “visits Agri Rando”).

These Terms and Conditions apply to all bookings for visits  made via the website www.agrirando.fr
(Hereinafter “the Site”).

The company reserves the right to modify these at any time by publishing a new version on the Site.

The applicable Terms are those then in effect on the date of payment.

The company ensures that acceptance of the Terms is clear and unqualified by setting up a checkbox and a validation click.

You declare to have knowledge of all these Conditions of Sale, related to “visits Agri Rando ‘,
and accept without restriction or reservation.

Booking on the Site, you acknowledge to have given all necessary advice and information to ensure the suitabilityof the visit”Agri Rando” for your needs.

You declare to be able to lawfully contract under French laws or validly represent the individual for whom you commit yourself Unless proved otherwise, the information recorded by the individual enterprise constitutes proof of all transactions.

Article 2: Services

The essential characteristics of “visits Agri Rando”  and their prices are available on the website.

The company is committed to honoring your reservation within the limit of  the maximum number of participants allowed in the 4X4 vehicle, stated on the website and Agri Rando flyer.

You certify having been informed in detail of the payment terms and fulfilment of the contract .

This contractual information is presented in detail and in French. According to French law, they are subject to a summary and confirmation when validating your reservation.

Article 3: Prices

Prices of “Agri Rando” tours sold through the Site are in euros, VAT not applicable under section 293 B of the Tax Codes and accurately determined on the “booking-prices’ for visits.

The company reserves the right to change prices at any time in the future.

Article 4: Conclusion of booking online

To book on the website, you should at least go through the following step:

Entering your customer information (identity, address:

  • Acceptance of these General Terms;
  • Checking the reservation data and, if appropriate, correct the mistakes;
  • Follow instructions for payment, and payment of “visits Agri Rando”.

You will receive a receipt confirming the reservation and an email confirming your booking payment.

For the purposes of  implementing a proper reservation and in accordance with Article 1316-1 of the Civil Code, you agree to provide truthful information concerning your identity.

The Company reserves the right to refuse a booking eg abnormal request, made in bad faith or
for any improper motive.

Article 5: Payment

Payment is due immediately upon booking. You can pay by credit card, PayPal account or ANCV checks. Cards issued by banks outside France must be international bank cards (such as MasterCard or Visa).

The secure online payment by credit card is done via the Paypal website. Your bank details are encrypted. They do not circulate on the Internet and can not be intercepted. They are not disclosed to the company.

Once payment is made by the Client, the transaction is debited immediately after checking the information. In accordance to Article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By communicating your bank details during the sale, you authorize the company to debit your card for the amount concerning the price indicated. You confirm that you are the legal owner of the card to be debited and that you are legally entitled to make use of it. In case of error, or failure to debit the card, the booking for the “visit Agri Rando” and the order are immediately cancelled.

Article 6: Withdrawal period

In accordance to  Article L. 221-21-08 of the Consumers Code, the right of withdrawal may not be exercised for contracts concerning provision of services, other than residential accommodation, goods transport services , car rentals, catering or recreational activities to be provided on a date or at a specific period.
Refund: except in cases of force majeure (illness on presentation of a medical certificate, death …), the customer can change or cancel his  reservation without charge up to  three days before the scheduled date of execution of the service and specifically requested by mail to: agrirando@orange.fr. After this time any change or cancellation will not be eligible for reimbursement.

Article 7: Claims

If you are dissatisfied with an Agri Rando tour, you can send a complaint by mail to agrirando@orange.fr

Article 8: Protection of personal data

Under the Data Protection Act of 6 January 1978, you have the right to question, access, modification, opposition and correction of your personal data.

By adhering to these Terms and Conditions, you agree that the company collects and uses this data for the realization of the present booking,.

Article 9: Intellectual property rights

Trademarks, domain names, products, software, images, videos, texts or generally any object of intellectual property rights information are and remain the exclusive property of Gilles Dupuy. No assignment of intellectual property rights is conducted through these Terms. Total or partial reproduction, modification or use of such property for any reason is strictly prohibited.

Article 10: Retention of title clause

“Visit Agri Rando” remain the property of the company until full payment.

Article 11: Force majeure

The execution of the company’s obligations in terms of the present contract  shall be suspended upon the occurrence of a fortuitous event or force majeure that prevents its accomplishment. The company will notify the customer  of such an event as soon as possible.

Article 12: Nullity and modification of the contract

If any of the conditions of this contract are cancelled, this shall not result in the nullity of the other conditions remaining between the parties. Any contractual modification is valid only after a written agreement signed by both parties.

Article 13: Applicable law

All clauses in these general conditions of sale, as well as all booking operations of “Visits Agri Rando”  referred to therein, will be subject to French law.
